NEW YORK, NEW YORK -- JMF successfully represented a client, a major consumer product manufacturer, in a federal trademark infringement and counterfeiting action. JMF prepared a Complaint alleging violations of the Lanham Act, including counterfeiting and trademark infringement, unfair competition and false designation, trademark dilution, and violations of state trademark infringement, trademark dilution and deceptive trade practice laws. Upon filing the Complaint in federal court, JMF obtained both a temporary restraining order and an order for the seizure of counterfeit products together with all the documents relating to the defendant’s counterfeiting operation. Within a week of filing the complaint, the federal marshal service and JMF attorneys seized documents and hundreds of cases of counterfeit product from the defendant’s warehouse. The case was ultimately resolved by a settlement agreement in which the defendant agreed to pay money damages to JMF’s client, and execute a personal guaranty and confession of judgment.
